T&C introduction
Welcome. These Terms and Conditions ("T&Cs") govern the services provided by Noa Rockman & the Encounter Learning Centre ("Therapist", "I") through this private psychotherapy practice ("Practice", "Service"). By booking and attending sessions, you agree to these T&Cs. If you have any questions about this document, please contact me before continuing with the service.
1. Definitions

Client: The individual receiving psychotherapy services.

Therapist: The practitioner providing psychotherapy services.

Session: A pre-arranged psychotherapy appointment between the Therapist and the Client.

Service: The psychotherapy services provided by the Therapist.
2. Confidentiality
As a psychotherapist bound by the BACP/NCP ethical frameworks, I maintain the strictest confidentiality concerning all personal information and the content of therapy sessions, except in the following situations:

If I am required to disclose information by law or under a court order.

If I have reason to believe there is a serious risk of harm to the Client or others, including safeguarding concerns.

With the explicit written consent of the Client to share information with a third party (e.g., another healthcare provider).
All data, including session notes and communications, will be securely stored in compliance with the General Data Protection Regulation (GDPR) and only retained for as long as necessary.
3. Client Responsibilities

The Client agrees to attend sessions punctually and provide at least 7 days notice if they need to cancel or reschedule a session. Cancellations with less than 7 days notice will incur the full session fee.

The Client is responsible for providing accurate, honest, and up-to-date information regarding their mental and emotional health.

The Client understands that psychotherapy is a collaborative process and that outcomes may vary.
4. Service Delivery and Fees

Sessions will be held either in-person at the Hendon office or online via a secure platform, as agreed upon during the booking process.

Each session will last 50/60/75/90/120 minutes as agreed and will be charged at the agreed rate per session.

Outstanding Payments: In the event that payment remains outstanding for more than 30 days from the date of the invoice, and further contact with the Client is required to request payment, a handling fee of £30 will be applied to the outstanding balance.

Late Payment Interest: If payment is not received within 60 days from the due date, the Client will incur statutory interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, at a rate of 8% above the Bank of England base rate in force at the time the debt became overdue. This interest will accrue from the due date until full payment is received.

Annual Price Updates: My rates are reviewed and updated every January. The updated rates will apply to all sessions taking place from January 1st onward.
I also reserve the right to adjust prices at other times during the year with at least 30 days’ notice before any changes take effect.
5. Cancellation and Rescheduling Policy

A minimum of 7 days notice is required to cancel or reschedule a session. Cancellations made with less than 7 days notice will incur a full fee charge unless due to exceptional circumstances.

If the Therapist must cancel or reschedule, reasonable efforts will be made to provide as much notice as possible and offer an alternative appointment.
6. Limits of Liability

The psychotherapy services provided are intended to support personal development, mental health, and well-being. However, no guarantees are made regarding the outcome of therapy.

The Client acknowledges that psychotherapy may evoke strong emotions and psychological discomfort. The Therapist is not liable for any emotional distress caused during the course of therapy unless arising from gross negligence or malpractice.

The Therapist is not responsible for any damage, injury, or loss arising from the Client's failure to disclose relevant medical or psychological information.

The liability of the Therapist for any claims arising under these T&Cs is limited to the amount paid for the service in the twelve months prior to the claim.
7. Data Protection and Privacy

The Therapist complies with the GDPR and other relevant data protection laws. Personal data will be collected, stored, and used only for the purpose of providing psychotherapy services and fulfilling legal obligations.

All personal information will be stored securely and kept confidential, except where disclosure is required by law or with the Client's explicit consent.

8. Complaints Procedure

If the Client is unhappy with any aspect of the service provided, they are encouraged to discuss this with the Therapist in the first instance. Every effort will be made to resolve the issue.

If the complaint cannot be resolved, the Client may escalate the matter by contacting the BACP or NCIP, both of which provide an independent complaints process.
9. Termination of Services

Either party may terminate the therapy agreement at any time by providing written notice. The Client is responsible for any outstanding payments for services rendered.

In certain circumstances, the Therapist may recommend ending therapy if it is determined that the service is no longer appropriate or effective for the Client. Referrals to alternative providers may be made as appropriate.
10. Legal Proceedings and Testimonies

I do not provide legal reports, documentation, or written statements for use in any legal proceedings, including but not limited to court cases, custody disputes, or legal investigations.

I do not testify in court or serve as an expert witness under any circumstances.

In the event that I am legally compelled to provide testimony or participate in legal proceedings, I reserve the right to charge for any time involved, including preparation and attendance, at a rate of £160 per hour.
11. Intellectual Property

All materials provided by the Therapist during sessions, including written content, resources, or tools, remain the intellectual property of Noa rockman and the Encounter Learning Centre and are provided for personal use only.
12. Governing Law
These T&Cs are governed by the laws of England and Wales, and any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. By using my services, you agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation
